1. מבוא

אפליקציית Upivo ("האפליקציה") מכבדת את פרטיותך. מדיניות זו מפרטת איזה מידע אנו אוספים בעת השימוש באפליקציה, כיצד אנו משתמשים בו, עם מי אנו חולקים אותו, ואילו זכויות עומדות לרשותך.

האחראי על המידע ("בעל המאגר") הוא Upivo. לכל פנייה בנושא פרטיות ניתן ליצור קשר בכתובת: support@upivo.co.il.

2. המידע שאנו אוספים

אנו אוספים מידע שאתה מספק לנו ישירות וכן נתונים טכניים הנאספים באופן אוטומטי בעת השימוש באפליקציה:

• פרטי חשבון: שם, דרכי התקשרות (כגון טלפון או דוא"ל) וכינוי תצוגה.
• נתוני כניסה: הכניסה לאפליקציה מתבצעת באמצעות קוד חד-פעמי הנשלח לכתובת הדוא"ל שלך. אנו שומרים תיעוד של מועד שליחת הקוד ושל הכתובת שאליה נשלח, לצורך הגנה מפני שימוש לרעה ולצורך הגבלת קצב הבקשות. הקוד עצמו אינו נשמר אצלנו, והתיעוד נמחק אוטומטית בתוך 24 שעות.
• תוכן אישי ומידע רגיש: נתונים שאתה בוחר להעלות או להזין, כגון תמונות ומדדים גופניים (למשל משקל, מידות או נתוני התקדמות). אנו רואים בתמונות ובמדדים הגופניים מידע רגיש, ומעניקים להם רמת הגנה מוגברת. איסוף מידע זה נעשה רק על בסיס הסכמתך המפורשת, ואתה יכול לבחור שלא לספק אותו (הדבר עשוי להגביל חלק מתכונות האפליקציה).
• נתוני שימוש ומעורבות: מידע על פעילותך באפליקציה, הישגים, ניקוד והיסטוריית שימוש.
• נתונים טכניים: סוג מכשיר, מערכת הפעלה, אסימוני דחיפה (Push Tokens) לצורך קבלת התראות, ודיווחי שגיאות או קריסה.

3. הבסיס החוקי לעיבוד

אנו מעבדים את המידע שלך על בסיס אחד או יותר מהבאים:

• הסכמתך - למשל לצורך העלאת תמונות ומדדים גופניים ולצורך שליחת התראות. הסכמה זו ניתנת לביטול בכל עת (ראה סעיף 9).
• ביצוע חוזה / מתן השירות - לצורך ניהול חשבונך והפעלת תכונות האפליקציה שביקשת.
• אינטרס לגיטימי / חובה חוקית - לצורך אבטחת המערכת, מניעת שימוש לרעה ועמידה בדרישות הדין.

4. מטרות השימוש במידע

• מתן שירות ותפעול האפליקציה: ניהול חשבונך, מעקב אחר התקדמותך והפעלת התכונות השונות.
• תקשורת: שליחת עדכונים, התראות והודעות תפעוליות (ניתן לנהל את העדפות ההתראות דרך הגדרות המכשיר).
• שיפור ופיתוח: ניתוח נתוני שימוש (במידת האפשר במתכונת מצטברת או ללא זיהוי) לאיתור תקלות, שיפור חוויית המשתמש ופיתוח תכונות.

5. שיתוף מידע וצדדים שלישיים

איננו מוכרים את המידע האישי שלך. אנו חולקים מידע אך ורק עם ספקי שירות (Sub-processors) החיוניים לתפעול הטכני של האפליקציה, המחויבים בהסכם לשמירה על סודיות ואבטחת מידע ולשימוש במידע רק לפי הנחיותינו. קטגוריות הספקים כוללות:

• שירותי ענן ואחסון מסדי נתונים;
• שירותי הפצת התראות דחיפה;
• שירותי ניטור ודיווח קריסות.

בנוסף, ייתכן שנחשוף מידע אם נידרש לכך על פי דין, צו שיפוטי או רשות מוסמכת.

6. העברת מידע אל מחוץ לישראל

המידע מאוחסן ומעובד בשרתים הממוקמים באיחוד האירופי. מאחר שהאיחוד האירופי כפוף למשטר הגנת פרטיות מחמיר (GDPR), אנו נוקטים באמצעים להבטחת רמת הגנה נאותה למידע, בהתאם לדרישות הדין החל.

7. אבטחת מידע ונראוּת בפני משתמשים אחרים

אנו מיישמים אמצעי אבטחה טכנולוגיים וארגוניים מקובלים להגנה על המידע.

משתמשים אחרים באפליקציה ייחשפו רק למידע שהוגדר כציבורי, כגון שם התצוגה שלך והדירוג הכללי.

מדידות גוף — גלויות לך בלבד

המשקל שלך, הגובה, יעד המשקל ותמונות ההתקדמות האישיות שלך גלויים לך בלבד. הם אינם מוצגים למשתמשים אחרים, ואף לא לצוות הסטודיו או למנהלי הסטודיו — גם לא למנהל/ת שיצרו את האתגר שבו השתתפת.

ההגבלה אינה הסתרה בממשק בלבד: היא נאכפת בשכבת מסד הנתונים עצמה, כך שגם דרך ממשק הניהול אין מסלול שמחזיר את הנתונים האלה.

כאשר רישום שקילה מזכה אותך בנקודות באתגר, הסטודיו רואה שהשקילה בוצעה ואת הנקודות שנזקפו — אך לעולם לא את הערך שנרשם.

8. שמירת נתונים ומחיקת חשבון

אנו שומרים את המידע האישי כל עוד חשבונך פעיל, או לפרק הזמן הדרוש למטרות שלשמן נאסף:

• פרטי חשבון ותוכן אישי - למשך קיום החשבון.
• דיווחי שגיאה/קריסה - למשך הזמן הדרוש לאבחון תקלות ולשיפור יציבות האפליקציה בלבד, ולאחר מכן נמחקים או נשמרים במתכונת מצטברת.
• מידע שאנו מחויבים לשמור על פי דין - למשך התקופה הקבועה בחוק.

באפשרותך למחוק את חשבונך בכל עת דרך הגדרות האפליקציה (הוראות מפורטות בדף מחיקת חשבון). מחיקת החשבון היא מיידית - פרטיך האישיים ותכניך מוסרים ממערכותינו הפעילות מיד עם ביצוע הבקשה, למעט מידע שאנו מחויבים לשמור על פי דין. ייתכן שנשמור נתוני פעילות מצטברים או מנותקי־זיהוי (שאינם מאפשרים לשייך אותם אליך בפועל) לצורך שמירה על שלמות הסטטיסטיקות הכלליות.

9. הזכויות שלך

בכפוף לדין החל, עומדות לך הזכויות הבאות ביחס למידע שלך:

• עיון - לקבל אישור אילו נתונים מוחזקים לגביך ולעיין בהם.
• תיקון - לתקן מידע שגוי או לא מעודכן.
• מחיקה - למחוק את חשבונך ואת המידע האישי שלך.
• ניוד - לקבל עותק של המידע שמסרת בפורמט נגיש, ככל שהדבר רלוונטי.
• התנגדות / הגבלת עיבוד - להתנגד לעיבודים מסוימים.
• משיכת הסכמה - לבטל הסכמה שנתת, בכל עת, מבלי לפגוע בחוקיות העיבוד שבוצע לפני הביטול.

למימוש זכויות אלו ניתן לפנות אלינו בכתובת support@upivo.co.il. נשיב לפנייתך בתוך פרק הזמן הקבוע בדין.

10. פרטיות קטינים

השימוש באפליקציה אינו פתוח להרשמה חופשית, והוא מותנה באישור חברות במועדון המתאמן. אימות הזכאות והגיל, וקבלת הסכמה מפורשת של הורה או אפוטרופוס חוקי כאשר מדובר בקטין, נעשים במסגרת תהליך אישור החברות במועדון, בהתאם לדרישות הדין המקומי.

לאור אופי האפליקציה, אנו נוקטים משנה זהירות בכל הנוגע לקטינים: תמונות ומדדים גופניים של קטינים לא יוצגו בדירוגים ציבוריים או למשתמשים אחרים. אם נודע לנו שנאסף מידע מקטין ללא ההסכמה הנדרשת, נפעל למחוק אותו. הורה או אפוטרופוס המבקש לעיין במידע של קטין, לתקנו או למחקו - מוזמן לפנות אלינו בכתובת support@upivo.co.il.

11. שינויים במדיניות הפרטיות

אנו עשויים לעדכן מדיניות זו מעת לעת. עדכון תאריך "העדכון האחרון" יופיע בראש העמוד. במקרה של שינוי מהותי (למשל מטרות עיבוד חדשות או שיתוף עם ספקים נוספים), נודיע לך מראש באמצעים סבירים (למשל הודעה בתוך האפליקציה) ובמקרים הנדרשים נבקש את הסכמתך המחודשת.

Privacy Policy - Upivo

1. Introduction

The Upivo app (the "App") respects your privacy. This policy outlines the information we collect when you use the App, how we use it, who we share it with, and your rights regarding your data.

The party responsible for your data (the "data controller") is Upivo. For any privacy matter you can contact us at: support@upivo.co.il.

2. Information We Collect

We collect information you provide directly, as well as technical data collected automatically:

• Account Details: Name, contact information (such as phone or email), and display name.
• Sign-in Data: Signing in uses a one-time code sent to your email address. We keep a record of when a code was sent and the address it was sent to, to prevent abuse and to rate-limit requests. The code itself is never stored, and the record is deleted automatically within 24 hours.
• Personal & Sensitive Content: Data you choose to upload or enter, such as photos and physical metrics (e.g., weight, measurements, or progress data). We treat photos and physical metrics as sensitive information and apply a heightened level of protection. We collect this data only based on your explicit consent, and you may choose not to provide it (this may limit some App features).
• Usage & Engagement Data: Information about your activity, achievements, points, and usage history.
• Technical Data: Device type, operating system, push tokens for notifications, and error/crash reports.

3. Legal Basis for Processing

We process your data on one or more of the following bases:

• Your consent - e.g., to upload photos and physical metrics and to send notifications. You may withdraw this consent at any time (see Section 9).
• Performance of a contract / providing the service - to manage your account and operate the features you requested.
• Legitimate interest / legal obligation - for system security, preventing misuse, and complying with the law.

4. How We Use Your Information

• Service Provision: To operate the App, manage your account, track your progress, and provide features.
• Communication: To send updates, operational alerts, and notifications (manageable in your device settings).
• Improvement & Development: To analyze usage data (in aggregated or de-identified form where feasible) to troubleshoot bugs, improve the experience, and develop features.

5. Data Sharing & Third Parties

We do not sell your personal data. We share information only with essential service providers (sub-processors) required for the technical operation of the App, who are contractually bound to confidentiality and security and to using the data only per our instructions. Categories of providers include:

• cloud storage and database hosts;
• push notification delivery services;
• monitoring and crash-reporting services.

We may also disclose information where required by law, court order, or a competent authority.

6. International Data Transfers

Your data is stored and processed on servers located in the European Union. As the EU is subject to a strict data-protection regime (GDPR), we take measures to ensure an adequate level of protection for your data, as required by applicable law.

7. Data Security & Visibility to Other Users

We implement standard technical and organizational security measures.

Other users will see only information designated as public, such as your display name and general ranking.

Body measurements — visible to you alone

Your weight, height, goal weight and personal progress photos are visible to you alone. They are not shown to other members, nor to studio staff or studio administrators — including the administrator who created the challenge you took part in.

This is not merely hidden in the interface: it is enforced in the database layer, so there is no path through the admin interface that returns this data either.

When recording a weigh-in earns you points in a challenge, the studio can see that a weigh-in happened and how many points were awarded — but never the recorded value.

8. Data Retention & Account Deletion

We retain personal data for as long as your account is active, or as needed for the purposes it was collected for:

• Account details and personal content - for the life of the account.
• Error/crash reports - only for as long as needed to diagnose issues and improve stability, after which they are deleted or retained in aggregated form.
• Data we are legally required to keep - for the period set by law.

You may delete your account at any time via the App's settings (step-by-step instructions on the Account Deletion page). Account deletion is immediate - your personal details and content are removed from our active systems as soon as the request is made, except data we are legally required to retain. We may retain aggregated or de-identified activity data (which cannot in practice be linked back to you) to maintain the integrity of overall statistics.

9. Your Rights

Subject to applicable law, you have the following rights regarding your data:

• Access - to know what data we hold about you and to review it.
• Correction - to fix inaccurate or outdated information.
• Deletion - to delete your account and personal data.
• Portability - to receive a copy of the data you provided in an accessible format, where relevant.
• Objection / restriction - to object to certain processing.
• Withdrawal of consent - at any time, without affecting the lawfulness of processing done before withdrawal.

To exercise these rights, contact us at support@upivo.co.il. We will respond within the timeframe required by law.

10. Children's Privacy

The App is not open to free sign-up; access is conditional on approval of membership in the associated training club. Verification of eligibility and age, and obtaining the explicit consent of a parent or legal guardian where a minor is involved, are carried out as part of the club's membership-approval process, in accordance with applicable local law.

Given the nature of the App, we take extra care regarding minors: photos and physical metrics of minors are not displayed in public rankings or to other users. If we learn that data was collected from a minor without the required consent, we will act to delete it. A parent or guardian who wishes to review, correct, or delete a minor's data may contact us at support@upivo.co.il.

11. Changes to This Policy

We may update this Privacy Policy periodically. The "Last updated" date at the top will reflect changes. For material changes (e.g., new processing purposes or additional providers), we will notify you in advance by reasonable means (such as an in-app notice) and, where required, seek your renewed consent.
